Defendant:
Computer Transport Services Ltd t/a Fliway
A man left tetraplegic after boxes of kitset furniture fell on him from the back of a truck was been awarded reparations of $120,000.
Computer Transport Services Ltd, trading under the name Fliway, was also fined $49,500 under s6 of the HSE Act (Palmerston North DC, July 23 2009).
The victim had been helping load freight into the truck. When it was almost ready to depart he was asked to put a hand barrowin the truck. As he unbolted the rear side door a load of flat-pack boxes of kit-set furniture that was stacked against the door fell onto him.
As a result of being struck by the falling freight he suffered a severe neck injury and is now a tetraplegic. The DoL said the company had failed to identify the hazards associated with stacking freight against doors, nor had it developed an effective strategy to control them.
