SCOTT JAMES TURNBULL, JAMES PHILIP TURNBULL and MARGARET TURNBULL, trustees of the JP and M Turnbull Family Trust trading as AUCKLAND RACEWAY, were each fined $5000 under s16(2)(b)(i) and ordered to pay $10,000 in reparations after an 11-year-old girl who was visiting the defendants’ go kart track was scalped when her hair caught in the rear axle of the kart she was driving. As those in control of a place of work, the defendants should have ensured the girl’s hair was securely held inside her helmet, and that the kart’s axle was guarded so the moving parts could not be accessed (Waitakere DC, January 24).
