Department of Labour v Arthur Subritzky (DC, 02/06/05)

OSH Tracker

Defendant:
Arthur Subritzky
Linesman ARTHUR SUBRITZKY was fined $750 under s19(b) after a co-worker was crushed between a crane truck and a fence post while the pair were attempting to use the crane to knock over a tree. As the tree fell, the crane boom snagged in its branches, lifting the rear of the truck off the ground and slewing it sideways, where it pinned the victim against a fence. He suffered severe internal injuries and fractures, and died some time later, of apparently unrelated causes. The defendant was supervising the tree removal work and should have known that the crane, which was designed to lift power poles, was not suitable for such a purpose (Kaitaia DC, June 2).
