The worker responsible for felling the tree, NEIL THOMAS FULLER, was later fined $1000 under s19(b) and ordered to pay $500 in reparations to the more severely injured man. He had been trimming fallen trees near were the victims were working but believed they had seen him prepare for felling and would stay at a safe distance. At the time of the accident the injured men were some 34 metres from the base of the 39 metre tree (Greymouth DC, 25 March 2004.)
