AKITA CONSTRUCTION LTD was fined $4000 under s16(1)(b) after an employee dislocated an elbow while attempting to climb down a scaffold lacking proper access. The company had contracted out the construction of the scaffold but had not ensured the scaffolding was suitable or that access ladders were provided. OSH had visited two months before and prohibited work until fall protection barriers were installed. The victim was awarded $3000. (Auckland DC, 3 March)

On the same day, AKITA was fined a further $1500 on another s16(1)(b) charge following an OSH visit to the same construction site a month after the accident. The inspector observed workers at risk of a fall of eight metres operating from scaffolding which was inadequately planked and guarded, to which no safe access was provided, and which was founded on unstable sole plates.
