Relating to the same case, employees PHILIP LESLIE CHING and KANE NORMAN HAIKA were each convicted under s19(a) and fined $250 for their part in the incident. Ching, who was supervising Haika, failed to ensure the work platform suspended at a height of 11 metres was safely secured to the lifting hook; that Haika’s harness was secured independently; and failed to stop Haika from engaging in a dangerous practice. For his part, Haika swung the skip he was standing in against the wall to assist demolition, used two instead of four running chains, and failed to secure his own harness.
