Taranui Farms Ltd was fined $5000 after an employee's left arm was torn off by a revolving transmission shaft assembly on a harvesting machine. Evidence from other workers that the assembly was completely unguarded, and that the company had warned people to stay away from the assembly, was rejected by the Court, which heard conflicting evidence about the extent of the guard provided. It also found the company's warning had been of a general nature, and allowed two senior staff to recant from earlier signed statements that the guard had been identified as a source of danger. The defendant was accordingly convicted under s50 rather than s49 of the Act. All the fine was awarded to the injured employee. (Hastings DC, 28 March)
