OSH Tracker

Defendant:
Alliance Group
Failure to adequately guard the in-running nip on a conveyor belt has resulted in a fine of $10,000 being imposed on Alliance Group Limited, after a worker climbed over the belt to check the bearings on the transmission side of the conveyor.  While he was lying under the conveyor the man's arm became trapped and sustained a compound fracture and severe muscle damage. In determining the penalty the Court noted the 'contributory negligence' of the worker in crawling under the conveyor belt while it was still in operation. Half the fine was awarded to the injured man. (Dunedin DC, 26 June)
