Building contractor Miden Construction Company Limited was fined $2500 in the Otahuhu DC on 10 March for failing to ensure employee safety, namely there was the risk of a worker falling five metres from a building under construction.  In September last year an OSH inspector observed one of the firm's employees working from the building framework without a suitable working platform or any other safety device to prevent him falling.  In pleading guilty the firm argued that the worker was only on the framework for five minutes to tighten knobs.The Court however did not accept that it was possible to look at five minutes in isolation, further commenting that the prosecution was the culmination of three inspections and that a proactive approach to the legislation was required.
