Department of Labour v Donald Wright (DC, 17/11/95)

OSH Tracker

Defendant:
Donald Wright
After a defended hearing, sawmill owner Donald Wright was fined $5000 after a part time worker was killed in an unguarded drive belt area. He was struck on the head by the bolts that joined the continuous machine drive belt.  The Court noted that it was well-establishe law that contributory negligence by an employee did not relieve the employer of his responsibilities under the Act, and that employers must be on guard against 'unthinking employees'.
