Accident Compensation Cases

Gamble v Accident Compensation Corporation (DC, 30/11/15)

Judgment Text

RESERVED JUDGMENT OF JUDGE A N MACLEAN
Judge A N MacLean
[1]
This appeal was lodged on 28 August 2014. Submissions on behalf of the appellant were to be filed by 12 January 2015.
[2]
After not receiving submissions, the Registry wrote to the appellants advocate three times by registered post on:
22 May 2015
7 August 2015
28 August 2015
[3]
After receiving no response or submissions, the Registry emailed the advocate on 29 September 2015 requesting they make contact by close of business that day or the matter will be referred to a Judge for directions.
[4]
A response was not received and the matter was referred to me.
[5]
On 22 October 2015 I directed that unless submissions were filed and served by 5 November 2015, the appeal would be dismissed.
[6]
On 5 November 2015 the advocate made the first contact with the Registry since the appeal was lodged. He requested a further two weeks to file submissions due to unforeseen personal circumstances. I granted that extension bringing the filing date to 19 November 2015.
[7]
To date, no submissions have been filed on behalf of the appellant. Therefore, I accordingly dismiss the appeal. There is no issue as to costs.
