Accident Compensation Cases

Perkins v Accident Compensation Corporation (DC, 10/09/08)

Judgment Text

DECISION OF JUDGE M J BEATTIE
Judge M J Beattie
[1]
This appeal arises from a decision of Reviewer, Mr M J Dunn, dated 25 June 2007, and relates to Review Application No. 100959.
[2]
The appellant had made application to review a letter from the respondent dated 29 January 2007 to her GP, Dr Karl. The letter to Dr Karl sought his input into the Draft Rehabilitation Plan which had been formulated.
[3]
The appellant's application for review contends that Dr Karl was operating under an invalid Consent to Disclosure Form.
[4]
In his decision, the Reviewer determined that the matter of the Consent Form did not constitute a decision within the meaning of Section 6 of the Act, and he therefore declined jurisdiction to consider the substantive matter.
[5]
It is the case that the respondent's use of a Consent Form is not a reviewable decision, nor was the letter of 29 January 2007 to Dr Karl a reviewable decision. The review decision was correct.
[6]
Accordingly, this appeal is dismissed.
