Accident Compensation Cases

Perkins v Accident Compensation Corporation (DC, 16/09/08)

Judgment Text

DECISION OF JUDGE M J BEATTIE
Judge M J Beattie
[1]
This appeal arises from a decision of Reviewer, Mr M J Dunn, dated 26 June 2007, and relates to Review Application No. 51361.
[2]
The Reviewer found that the appellant had filed an application for review which had not identified any decision.
[3]
Annexed to the application was an extract from a check-list compiled by the appellant and which referred to the Corporation agreeing to write to Dr Newburn about certain matters.
[4]
In his decision the Reviewer determined that there was no jurisdiction to consider the application as no reviewable decision within the meaning of Section 6 of the Act had been identified.
[5]
The appellant's Notice of Appeal did not specify the grounds for appeal nor the remedies sought and can only be described as a pro forma Notice of Appeal.
[6]
I have considered the Review Decision and find it correct both in fact and law and I confirm that there was no decision within the meaning of Section 6 which could be the subject of review, or indeed appeal.
[7]
For the foregoing reasons therefore this appeal is dismissed.
