This appeal was scheduled for hearing before me on 13 July 2007 at 2.15 p.m. On two occasions the Registry had forwarded registered letters to the appellant at his residential address advising of that date of hearing. The later of those two letters, namely the letter dated 4 July 2007, advised the appellant of a change of time on that date from 3.30 p.m. to 2.15 p.m.

There was no appearance on behalf of the appellant nor was any contact made by the appellant with the Registry advising of the reason for his non-attendance.

At 2.25 p.m., Mr McBride for the Respondent made an application pursuant to Section 161 of the Act that the appeal be dismissed for the appellant's failure to appear at the time appointed for the hearing of the appeal.

There being no appearance of the appellant nor any advice from him as to a reason why he could not attend that hearing, this appeal is dismissed pursuant to Section 161(3)(a) of the Act.
