Accident Compensation Cases

Evans v Accident Compensation Corporation (DC, 05/07/06)

Judgment Text

M J Beattie Judge
At the calling of this appeal on 27 February 2006 I noted that the Appellant had advised that he could not attend Court but that he would accept any “Directions” the Court made.
I therefore noted the file that the Appellant had not taken any positive steps to prosecute his appeal, and had not filed submissions despite several requests by the Registry.
Accordingly I directed that the appellant was to file and serve his written submissions within 21 days of the “date of the notice” of this direction. That date fell on the 4th April.
I am satisfied that the Registry has properly forwarded my direction to the Appellant. They also advised the Appellant that, in the event that he failed to comply with my Direction, then his appeal would be dismissed for want of prosecution pursuant an application made by the Respondent on 27th February 2006.
The Registry provided me with the file today, 4th July 2006, and I note that no further communication has been received from the Appellant.
Therefore pursuant to the Respondent's application of 27th February 2006 I dismiss this appeal for want of prosecution.
