Accident Compensation Cases

Young v Accident Compensation Corporation (DC, 19/06/03)

Judgment Text

J Cadenhead Judge
The appellant, through his counsel, lodged an appeal on the 17th June 2002 against a decision to suspend entitlements.
On the 12th July 2002 the Registry requested counsel to file submission on behalf of the appellant in support of the appeal.
Three days later counsel advised the Registry that he was withdrawing from the matter. A contact address for the appellant was also supplied.
A letter was sent to the appellant at the address supplied. On 31 July 2002 the appellant rang the Registry and advised that he would be engaging another solicitor and he needed extra time to file submissions.
Since that date the appellant has not contacted the Registry. The Registry wrote to the appellant at the address supplied by his former solicitor on 14th November 2002 and 24th April 2003. There has been no response.
A check of the Internet white pages for a phone number for the appellant also proved fruitless.
There has been no contact from the appellant apart from the one phone call of 31st July 2002.
I therefore STRIKE OUT this Appeal for want of prosecution.
