164 Disclosure of information to Corporation

Disclosure of information to Corporation
(1)
In this section, unless the context otherwise requires, the term payment means any payment under this Act; and includes any provisions in respect of rehabilitation.
[(2)
The purpose of this section is to facilitate the disclosure of information by the [[Department of Labour, Department of Corrections, the New Zealand Customs Service, the department for the time being responsible for the administration of the Social Security Act 1964]], the Ministry of Health, any funder, and any hospital and health service (in this section each called “the Department”) to the Corporation for the purposes of verifying—
(a)
The entitlement or eligibility of any person to or for any payment; or
(b)
The amount of any payment to which any person is or was entitled or for which any person is or was eligible.]
(3)
For the purpose of this section, the Corporation may from time to time, in accordance with arrangements made from time to time between the Corporation and the Department concerned, request the Department to supply, in respect of persons who are receiving, have received, or have applied to receive any payment—
(a)
Such biographical information as is sufficient to identify those persons, including their addresses; and
(b)
Such details of those persons held by that Department as are necessary for the purpose of this section; and
[(c)
Such information and details referred to in paragraphs (a) and (b) of this subsection as may be necessary for the purposes of this section in respect of persons who are receiving, have received or have applied to receive any treatment, service, rehabilitation, related transport, or certificate from any such person.]
(4)
On receipt of a request made under subsection (3) of this section, the Department may supply the information requested to any officer or employee or agent of the Corporation who is authorised in that behalf by the Corporation.
(5)
Information supplied pursuant to a request made under subsection (3) of this section may be supplied in such form as is determined by agreement between the Corporation and the Department concerned.

This Act was repealed, as from 1 July 1999, by s 417(1) Accident Insurance Act 1998 (1998 No 114).
Subsection (2) was amended, as from 1 July 1993, by s 49(1) Accident Rehabilitation and Compensation Insurance Amendment Act (No 2) 1993 (1993 No 55) by inserting the words “, the Ministry of Health, any purchaser, and any Crown health enterprise (in this section each called ‘the Department’)”.
Subsection (2) was amended, as from 1 October 1995, by s 10(3) Department of Justice (Restructuring) Act 1995 (1995 No 39) by substituting the word “Corrections” for the word “Justice”.
Subsection (2) was amended, as from 1 October 1996, by s 289(1) Customs and Excise Act 1996 (1996 No 27) by substituting the words “New Zealand Customs Service” for the words “Customs Department”.
Subsection (2) was substituted, as from 1 July 1998, by s 5(4) Health and Disability Services Amendment Act 1998 (1998 No 74).
Subsection (2) was amended, as from 1 October 1998, by s 11 Employment Services and Income Support (Integrated Administration) Act 1998 (1998 No 96) by substituting the words “Department of Labour, Department of Corrections, the New Zealand Customs Service, the department for the time being responsible for the administration of the Social Security Act 1964” for the words “Departments of Labour, Corrections, and Social Welfare, and the New Zealand Customs Service”.
Subsection (3)(b) was amended, as from 1 July 1993, by s 49(2) Accident Rehabilitation and Compensation Insurance Amendment Act (No 2) 1993 (1993 No 55) by inserting the expression “; and”, and by adding paragraph (c).

(1)

(4)
On receipt of a request made under subsection (3) of this section, the Department may supply the information requested to any officer or employee or agent of the Corporation who is authorised in that behalf by the Corporation.
(5)
Information supplied pursuant to a request made under subsection (3) of this section may be supplied in such form as is determined by agreement between the Corporation and the Department concerned.
