Fined $35,000 for a breach of the Health and Safety at Work (Asbestos) Regulations 2016 and two breaches of the HSW Act, after failing to manage the risk of asbestos when removing asbestos-containing material from a shed. He and another worker used hand tools to break up material, failed to use masks or protective clothing, and failed to manage airborne asbestos fibres. He also failed to notify WorkSafe of Class B removal work. He was also ordered to pay reparation of $2580 for site remediation.

The Fletcher Construction Company Ltd

WorkSafe has accepted the company’s enforceable undertaking after a 2016 incident in which a man’s leg was broken in several places when a temporary wall collapsed onto him. He was working in a hole dug as a temporary sump to pump out water after heavy rain. The sump had been built using one-tonne concrete blocks but without design drawings or engineering sign-off. Actions required to be taken by the company are expected to cost at least $200,000 and include assisting Site Safe to develop training for temporary works, establishing a H&S forum with labour hire firms, and developing a H&S module for a local secondary school and providing relevant work experience.
