In the Manukau District Court counsel for the failed quadbike adventure tourism company accepted WorkSafe's evidence of failings - including defective quadbikes, inadequate safety helmets, and a lack of supervision and an emergency plan - but argued that because the crash, which killed Australian tourist Chelsea Callaghan, took place on a public road it did not constitute a 'place of work', the company could not be held liable.
