An OHS consultant retained by a British firm as its safety advisor was convicted and fined for writing risk assessments for two machines which stated their guarding was acceptable when - as it turned out - it clearly wasn't.

The December edition of SHP reports that his error came to light when two employees had fingers severed in guillotines in two separate incidents within six weeks of each other last year. Investigating, the Health and Safety Executive found one machine had no guard and the other was inadequately guarded.

The safety advisor, John Whiffin, had written risk assessments for both machines in 2010 which stated their guarding was present and acceptable. He was convicted of breaching regulation 11(1) of the Provision and Use of Work Equipment Regulations and fined £700 with an additional £4000 in costs.

The company, Porvair Filtration Group in Hampshire, had been issued with a prohibition notice after the second incident requiring it to stop using three guillotines until proper guarding was installed, and an improvement notice requiring it to obtain competent health and safety advice.

In court, it was fined £5000 and ordered to pay £20,358 in costs.
