Recent developments prompted by the Pike River explosion include new regulations for the petroleum extraction sector, changes to the Crown minerals regime, and an investigation into the activities of two Government agencies.

Chris Finlayson, acting Minister of Labour, has announced that from June 2013 new regulations under the HSE Act would come into force for petroleum exploration and extraction, including the requirement to prepare a safety case for major new explorations, and to report near miss events. He also flagged the development of an Approved Code of Practice for employee participation to cover the oil and gas sector.

His cabinet colleague Phil Heatley announced that in light of Pike River the Crown Minerals (Permitting and Crown Land) Bill currently before Parliament would be amended so that:

  • The Minister of Energy and Resources must consult the health and safety regulator before issuing a Tier 1 exploration or mining permit.
  • Tier 1 mining activities must not start until the regulator is satisfied OHS requirements have been met.
  • The definition of 'good industry practice' will include OHS considerations.

Meanwhile, MBIE has commissioned an independent report into whether failings by staff at the former Department of Labour or the former Ministry of Economic Development, or the failure of systems within the two agencies, contributed to the Pike River disaster. Should the investigation uncover individual failings, it will also look into whether they warrant formal employment investigation. The investigation is to be carried out by David Shanks of the Ministry of Social Development and one other person yet to be named. They will look at the operating and decision-making environment at both agencies in the years leading up to the November 2010 mine explosion.
