The CTU believes that minimum standards are essential for the protection of workers, especially in the current New Zealand market. These minimum standards are meaningless if the Government is not prepared to enforce them. The CTU believes that individuals should have the right to initiate prosecutions under the HSE Act in order to provide some means of enforcing the law where OSH is failing to do so. Currently only warranted OSH inspectors are permitted to initiate these prosecutions, and the number of prosecutions is severely restricted by the Government’s apparent reluctance to provide sufficient resources to enforce the law. Clearly the situation is failing to deliver the level of safety to which New Zealand workers are entitled.
